Khalid Sheikh Mohammed did not claim US defeat immigration

In a major blow to the U.S. case against Khalid Shaikh Mohammed, the man accused of plotting the Sept. 11 attacks, a military judge ruled on Friday that the prisoner’s confessions to F.B.I. agents were not voluntary and cannot be used against him at trial. Prosecutors have described Mr. Mohammed’s interrogations in 2007 at the U.S.

Mohammed told C.I.A officers that he might send a shipping container from Japan loaded with personal computers, half of them packed with bomb materials, according to a foreign official briefed on the episode.

In Friday's court order, which has not been publicly released, Schrama suppressed the statements that Mohammed made to the FBI when he was interrogated over the course of four days in Guantanamo Bay in January 2007. Years earlier, Mohammed was captured and held by the CIA, which subjected him to waterboarding and other tactics that are widely viewed as torture during interrogation sessions — leading Mohammed's later statements to a separate FBI team to be challenged by attorneys.

The CIA had said the method was ... to the Senate report, Mohammed figured out a way to “beat the system,” often recanting information he told CIA officers to get them to stop the waterboarding....

A CIA officer described the procedure as "a series of near drownings''. But the report said some of the information given by Mohammed was fabricated.

But I think what's interesting about the Senate report, just to backup for second, is it's based on the CIA's internal communications. So it's basically quotations from emails and memos and cables of the CIA talking to itself. And in the case of Khalid Sheikh Mohammed, they are talking about the interrogation as it's going on.

On 5 February 2008, the CIA director Michael Hayden told a Senate committee that his agents had used waterboarding on Khalid Sheikh Mohammed. In June 2008, anonymous CA officers told the New York Times that Mohammed had been held in a black site or secret facility in Poland near Szymany Airport, about 100 miles north of Warsaw. During this time, he says that he was questioned by a CIA agent who also punched him several times in the stomach, chest and face, threw him on the floor, and trod on his face. He was also denied sleep throughout his detention in Pakistan.
